We build and deploy custom AI agents to help businesses:

Upsell and cross-sell more effectively

Re-engage old leads via SMS, web chat, or social DMs

Automate customer support via FAQ bots

You may access a live demo and/or request a customized agent tailored to your business needs.

2. Eligibility

By using our services, you confirm that you:

Are at least 18 years old

Have authority to bind the company you represent

Will provide accurate and up-to-date information

3. Use of AI Agents

You are responsible for how your AI agent is used once deployed. You agree:

Not to use the agent for unlawful, harmful, or deceptive purposes

Not to use the agent to generate or distribute sensitive personal data without consent

Not to impersonate individuals or businesses you are not affiliated with

We retain the right to suspend or revoke access to our services if usage violates laws or ethical guidelines.

4. Ownership & Licensing

You retain ownership of your brand assets and customer data.

We retain ownership of the AI frameworks, agent architecture, and intellectual property used to build your solution.

You receive a non-exclusive, non-transferable license to use the agent we build for you.

5. Fees & Payments

Custom agent builds are priced as agreed during onboarding.

Payments are processed via Stripe or PayPal.

All sales are final unless stated otherwise in writing.

Failure to pay may result in suspension or removal of your AI agent.

6. Data & Privacy

Your data is handled with strict confidentiality. We do not sell or share your business data.

You are responsible for complying with data privacy laws applicable to your users (e.g., GDPR, UK DPA, CCPA).

7. Third-Party Integrations

Your AI agent may integrate with third-party tools (e.g., SMS providers, Meta DMs, CRMs). We are not liable for outages or limitations of third-party services.

You are responsible for maintaining active accounts with those services if needed for your agent.

8. Warranties & Disclaimers

Our AI agents are powerful tools but cannot guarantee specific business results. You agree to use them as one part of your sales or support stack.

We provide services “as is,” without warranties of any kind, including fitness for a particular purpose.

9. Limitation of Liability

To the maximum extent allowed by law, XFortuna is not liable for any indirect, incidental, or consequential damages, including lost profits, lost data, or reputational harm arising from use of our services.

10. Modifications

We may update these Terms from time to time. Material changes will be posted on our website with a new effective date. Continued use after changes constitutes your acceptance.

11. Termination

You may stop using our services at any time. We may suspend or terminate your access for violation of these Terms.

12. Governing Law

These Terms are governed by the laws of Scotland, United Kingdom. Any disputes shall be resolved in the courts of Scotland.
